Terms and Conditions - KeepSafe Beneficiary Program

These Terms and Conditions ("Terms") govern participation in the KeepSafe Beneficiary Program ("Program"). The Program is administered by Picture Keeper, operated by Simplified IT Products, LLC ("we," "us," or "our"). By designating a beneficiary or submitting an inheritance claim through the Program, you agree to be bound by these Terms.


1. Program Overview

The KeepSafe Beneficiary Program allows an eligible KeepSafe user ("Requester") to designate a person ("Beneficiary") to inherit their KeepSafe file collection in the event of the Requester's death. Upon verification of the Requester's death and successful completion of the claims process, the Beneficiary will be granted access to the Requester's KeepSafe files.


2. Eligibility Requirements

Requester Eligibility

To be eligible to designate a Beneficiary under this Program, all of the following conditions must be met:

  • The Requester must be a resident of the United States.
  • The Requester must be an active KeepSafe subscriber at the time of their death, or must have held an active KeepSafe subscription within the three (3) months immediately preceding their death.
  • Users enrolled in a 1-month free trial are not eligible to participate in the Program as Requesters.
  • Users enrolled in a 12-month free promotional subscription are eligible to participate in the Program as Requesters.

Beneficiary Eligibility

  • The Beneficiary must be a resident of the United States. The Beneficiary must possess a valid United States phone number and a government-issued photo ID.
  • The Beneficiary must complete our identity verification process before they are eligible to submit an inheritance claim. See Section 5 for details.

Failure to meet any eligibility requirement may result in denial of participation or rejection of an inheritance claim.


3. Designating a Beneficiary

  • A Requester may designate a Beneficiary by specifying the Beneficiary's United States phone number within their KeepSafe account settings.
  • A Requester may update or remove their designated Beneficiary at any time prior to their death.
  • As many as two (2) Beneficiaries may be designated per KeepSafe account at any given time.
  • Designating a Beneficiary does not guarantee fulfillment of an inheritance claim. All claims remain subject to these Terms.

4. File Retention After Subscription Expiration

  • When a Requester's KeepSafe subscription expires, we will retain their files for a period of three (3) months following the expiration date, after which the files may be permanently deleted.
  • An inheritance claim can only be fulfilled if it is received and fully processed before any such deletion occurs.
  • We are not liable for files that are deleted prior to the receipt or processing of a valid inheritance claim.

5. Beneficiary Verification

  • Before submitting an inheritance claim, the Beneficiary must complete our identity verification process. This process may include confirming their identity via the phone number designated by the Requester, as well as any additional verification steps we may require.
  • Verification must be completed through our designated claims portal or support process.
  • We reserve the right to request additional documentation to verify the Beneficiary's identity and eligibility.

6. Submitting an Inheritance Claim

To submit a valid inheritance claim, the Beneficiary must:

  • Have completed the Beneficiary verification process described in Section 5.
  • Submit a certified copy of the Requester's death certificate as part of the claim.
  • Submit the claim by reaching out to our team at support@picturekeeper.com before the Requester's files are deleted in accordance with Section 4.

Incomplete or unverifiable claims will not be processed.


6a. Delivery of Files

  • Upon fulfillment of a valid inheritance claim, the Requester's files will be delivered to the Beneficiary on an Picture Keeper (or similar) drive.
  • The Requester's files may include any photos, videos, and contacts that the Requester has uploaded to KeepSafe. Metadata may not be included.
  • The drive will be provided at no charge, however shipping and handling costs are the responsibility of the Beneficiary. The current cost of shipping and handling is $10.99. This cost is subject to change at any time.
  • Shipping fees must be paid before the drive is fulfilled and shipped.
  • Delivery is available only to mailing addresses within the United States.
  • The replacement drive may not be the same style, model, or storage capacity as any drive previously owned by the Requester, but will have sufficient capacity to contain all eligible files associated with the Requester's account.

7. Disputes

  • We reserve the right to withhold release of files pending resolution of any dispute.
  • We are not responsible for adjudicating legal disputes regarding inheritance rights. Such matters may need to be resolved through appropriate legal channels.

8. Program Limitations and Availability

  • The Program is available only to residents of the United States.
  • The Program is subject to availability and may be modified, suspended, or discontinued at any time without prior notice.
  • We make no guarantee that a Beneficiary claim will be fulfilled in any specific timeframe beyond the minimum commitments described in these Terms.

9. Abuse and Fraud Prevention

We reserve the right to deny or revoke participation in the Program in cases of suspected abuse, fraud, misrepresentation, submission of falsified documentation, or violation of these Terms.


10. Access to Files

By participating in the Program as a Requester, you authorize us to grant access to your KeepSafe-stored files to your designated Beneficiary upon fulfillment of a valid inheritance claim. We do not use your files for any other purpose.


11. Changes to These Terms

We may update or modify these Terms at any time. Continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.
