Terms of Use - Picture Keeper Connect Mobile Application

1. Overview & Acceptance

Picture Keeper, operated by Simplified IT Products, LLC (“Picture Keeper Connect,” "Picture Keeper," “we,” “us,” or “our”), provides software, hardware, and cloud-enabled services designed to help users securely back up, manage, create, edit, and restore their photos, videos, and files.

These Terms & Conditions (“Terms”) govern your access to and use of Picture Keeper products and services, including Picture Keeper hardware, Picture Keeper applications, and optional features such as KeepSafe (collectively, the “Services”).

By accessing or using any Picture Keeper Service, you agree to these Terms.

2. Eligibility & Accounts

You must be at least 13 years old to use the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Use of Services

You agree not to:

  • Use the Services for unlawful purposes
  • Interfere with or disrupt the Services
  • Attempt to gain unauthorized access to systems or data
  • Misuse storage, backup, or cloud features

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

4. Content Ownership

You retain all rights to the content you store or upload using Picture Keeper Services.

By using the Services, you grant us a limited, non-exclusive license to process your content solely to provide the Services you request, including backup, restoration, and analysis features.

5. KeepSafe Service

The KeepSafe Service is an optional feature that requires an active subscription to use.

  • KeepSafe is currently available only to customers in the United States of America.
  • Subscriptions are billed through the applicable app store or payment provider.
  • KeepSafe may be offered with a free trial for eligible users. Trial availability, duration, and eligibility are determined by Picture Keeper and/or the applicable app store and may change at any time.
  • If you cancel your subscription before the end of the free trial period, you will not be charged. If you do not cancel before the free trial period ends, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee for the plan.
  • KeepSafe provides cloud storage for users' files. While we strive to maintain reliable service and performance, KeepSafe, like any online service, may experience occasional interruptions or downtime.
  • If your total stored data in KeepSafe exceeds one terabyte (1 TB), we reserve the right to apply compression or other processing to subsequently uploaded files in order to maintain system performance and efficiency. Such processing may affect file size, quality, or format.
  • Fees are non-refundable except as required by law.
  • Subscription availability, features, and pricing may change at any time.
  • By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

6. Intellectual Property

All Picture Keeper software, branding, logos, and technology are owned by Simplified IT Products, LLC or its licensors and are protected by intellectual property laws.

7. Termination

We may suspend or terminate access to the Services if you violate these Terms.
You may stop using the Services at any time.

Termination does not eliminate obligations incurred prior to termination.

8. Disclaimers

The Services are provided “as is” and “as available.”
We do not guarantee uninterrupted access, error-free operation, or that data loss will never occur.

9. Limitation of Liability

To the maximum extent permitted by law, Picture Keeper and Simplified IT Products, LLC are not liable for indirect, incidental, consequential, or special damages arising from use of the Services.

10. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
